Ohio Hemp & Cannabis Legislation Timeline

2016

House Bill 523 legalized medical marijuana in Ohio, establishing the Ohio Medical Marijuana Control Program. The program allowed patients with qualifying conditions to purchase and use medical marijuana from licensed dispensaries.

July 2019

Senate Bill 57 decriminalized hemp and hemp-derived products in Ohio, aligning with the 2018 Federal Farm Bill. Hemp was legally defined as cannabis containing less than 0.3% THC.

January 2020

The Ohio Department of Agriculture began licensing hemp cultivators and processors under the newly established Ohio Hemp Program.

August 2021

Ohio authorities clarified that Delta-8 THC derived from hemp is legal under state law, provided the total THC concentration remains below 0.3% on a dry weight basis.

November 2023

Issue 2 passed, legalizing recreational marijuana for adults 21 and older, allowing possession of up to 2.5 ounces and home cultivation of up to 6 plants per person (maximum 12 per household).

December 2023

Recreational cannabis possession and home cultivation became legal in Ohio. Retail sales were expected to begin after the establishment of regulatory framework.

2024

The Division of Cannabis Control continues developing regulations for the adult-use market while the existing medical program remains operational.
